Family Hit by Plane in Car Settles Lawsuit

April 4, 2007 -

A lawsuit over a 2005 accident in which an airliner crashed into a car killing a six-year-old boy has been settled.

The lawsuit was filed by the family of Joshua Woods against Southwest Airlines.

Joshua, six, died in his family’s car near Chicago’s Midway Airport, when a Boeing 737 owned by Southwest Airlines skidded off a snowy runway and crashed into it.

The Settlement

The Southwest Airlines spokesperson, Whitney Eichinger, declined to discuss the terms of the settlement. The family’s lawyer could not be reached for comment.

“Out of respect for the Woods family, we agreed not to discuss or disclose the terms of the settlement,” said Eichinger in a written statement.

“We know we cannot bring Joshua back, and we believe this settlement brings a tragic and difficult situation to a close.”

The manufacturer of the 737, Boeing, was also named in the suit.

The Accident

According to the lawsuit, the bad winter conditions should have caused the flight to be diverted to a safer airport. The suit claims that the pilots approached the airport unsafely and failed to properly brake, causing the plane to skid off the runway.

The plane went through a fence and into car traffic.

Joshua’s parents, Leroy and Lisa Woods, and his brothers were all hurt in the crash.
