Lawsuit Filed for Michigan Plane Crash

- April 17, 2008

A suit was recently filed on behalf of a man who was killed in a plane crash in Michigan during 2006.

The suit has been filed by two attorneys on behalf of the family of the man who was killed in the accident.

Family Files Suit

The suit was filed last week by the family of Joshua Trainor, 23, who died in the plane crash.

Donald Pagos, one of the attorneys for the Trainor family claims that an unspecified amount of damages have been requested.

Pagos and his partner in the case, Scott Pejic, chose to file the suit in Polk County, IA, since there are no caps on damages for lawsuits in this state.

“The father and mother retained me to file a lawsuit for the wrongful death of their son,” explains Pagos.

Defendants Named in Suit

CPRT Investment Corp. and the estates of John Trewet and Tom Dunphy, who were also killed in the crash, have all been named as defendants in the suit.

CRPT is an air charter for businesses and Trewet served as the officer and shareholder of the company.

Dunphy was the president of the company where Trainor worked.

Lawsuit Claims

The suit claims that Dunphy negligently chartered the plane because the pilot was not licensed to carry passengers.

The pilot was also not licensed to work with the instruments that were required under the weather conditions at the time of the crash, says the suit.
