Failure to Maintain or Repair an Aircraft

There are more than 1,000 airplane crashes every year. Many are caused by inadequate aircraft repair or a failure to adhere to repair schedules. When repair services fail in their duty to keep an airplane airworthy, the maintenance company may be guilty of negligence. Similarly, if airplane management fails to adhere to maintenance schedules and repairs, it can be held liable if something goes wrong.

If you or a loved one has been involved in an airplane crash, you might be able to collect compensation if negligence is determined. For more information, contact an aviation lawyer today.

Maintenance Problems

Commercial aircraft repair and routine inspections are required to be performed on a regular basis. The Federal Aviation Administration (FAA) has oversight and safety regulations on maintenance schedules for commercial airliners. Some airlines are known to place profits over the safety of the airplane passengers. Repair services are sometimes contracted out to unqualified or inexperienced maintenance crews in order to save money.

General aviation aircraft repair has less regulation and is usually only subject to annual inspections. As with repair services on commercial airlines, there can be a dangerous focus on correcting only what is currently wrong and ignoring problems that may develop in the future.

Aircraft maintenance includes:

  • Annual inspections
  • Heavy maintenance checks (airframe repair or refurbishment)
  • Repair or replacement of life-limited components
  • Repair of structural damage and corrosion
  • Speed modification
  • Repair of leaking fuel tanks

Contact an Aviation Attorney

When cost cutting measures or negligent repair services compromise safety, airplane crashes happen. Passengers and private pilots have a reasonable expectation that aircraft repair has been handled with care. If you or a loved one is harmed in an airplane accident, an experienced aviation attorney can investigate to determine if negligence occurred. You might be eligible for compensation.

Aviation Facts

  • Approximately 80 percent of all plane crashes occur shortly before or after takeoff or landing due to human error or mechanical failures.
  • According to an aviation accident survey of nearly 2,200 plane crashes from 1950 to 2004, the number one cause of aviation accidents is pilot error, which results in 45 percent of accidents. Undetermined causes: 33 percent. Mechanical failure: 13 percent.
  • In 2005, there were a total of 1,764 aviation accidents in the United States that resulted in 600 fatalities. Low-level maneuvering of an aircraft was the leading cause of fatal aviation accidents from 1998 to 2004.
  • In 2004, more than 70 percent of all plane crashes that ended in serious injury or fatality occurred during a personal flight. General aviation accidents occur more frequently than airline or business aviation accidents.
  • The most recent statistics on midair collisions has shown a steady decline. In 2004, there were 10 midair accidents resulting in 10 fatalities compared to 11 collisions in 2003 with 23 deaths.
